Where the first number quietly wins real money and real years: opening offers in a negotiation, was-now price tags, the listing price that bends professional appraisers, and a courtroom sentence pulled by a roll of the dice.

So far we’ve watched anchoring warp guesses in a lab, where the stakes are a gift card and your dignity. Now for the uncomfortable part: the same reflex is running, right now, in negotiations, shops, mortgage appraisals, and courtrooms — moving real money and real years of people’s lives. And here’s the through-line to keep in your pocket, because it’s an incentives point in disguise: the first number is the cheapest lever there is. It changes behavior without changing anyone’s payoffs. Nobody had to lower a price, sweeten a deal, or bribe a judge. Someone just said a number first, and everyone downstream quietly leaned toward it.

Negotiation: the first offer writes the story

Think of a negotiation like a tug-of-war where the rope starts wherever the first person plants it. Whoever speaks first doesn’t just make an offer — they decide which patch of ground you’ll both spend the next hour fighting over.

The evidence is blunt. Galinsky and Mussweiler (2001) ran negotiation experiments and found that final settlements correlate strongly with the first offer — the opening number predicts a large chunk of where the deal lands. This flips a piece of folk wisdom on its head. “Let the other side go first” is popular advice, but if you’re the informed party, making the first offer is usually the advantage: you get to set the anchor instead of adjusting away from theirs.

There’s a twist that feels almost too cute to be real: precise anchors stick harder. An opening offer of “9,850 dollars” pulls the final price more than a round “10,000 dollars.” Janiszewski and Uy (2008), and later Mason and colleagues, showed that precise numbers signal knowledge — a round number sounds like a placeholder, a precise one sounds like it came from a spreadsheet — and precision invites smaller adjustments. People nudge away from 10,000 in big 500-dollar hops, but away from 9,850 in tiny 50-dollar steps.

Worked number. Say two sellers list the same item. Seller A opens at 10,000; the buyer mentally adjusts down and lands near 8,500. Seller B opens at 9,850; the buyer takes it as a considered figure, adjusts in smaller steps, and lands near 9,100. Same product, same buyer psychology — and roughly 600 dollars of difference bought purely by how the first number was phrased. No extra value delivered. Just a cheaper lever pulled better.

When you make an informed first offer, reach for a precise, defensible number — and be ready to say why it’s that number. Precision plus a reason is the difference between an anchor and a wish.

Pricing & retail: the reference price racket

Every price tag you’ve ever seen was quietly auditioning a second, invisible price — the one you’re supposed to compare it to. That invisible number is the reference price, and retail is a factory for manufacturing favorable ones.

  • MSRP — the manufacturer’s suggested retail price is a suggestion the store often has no intention of charging. Its real job is to be the anchor: “MSRP 1,200 dollars” printed above “our price 899 dollars” makes 899 feel like a rescue.
  • “Was 1,200 dollars, now 499 dollars.” The struck-through original is a reference price. If the item never genuinely sold at 1,200, the “was” price is doing anchoring work, not honest accounting — which is exactly why fake original prices are regulated in many places.
  • Decoy items. A menu’s 95-dollar steak may exist to be ignored. It resets your reference price so the 42-dollar dish reads as sensible. The decoy doesn’t need to sell; it just needs to be seen.
  • Quantity limits. “Limit 12 per customer” sounds like a restriction. It’s an anchor. Wansink, Kent, and Hoch (1998) ran the famous soup-can study: shoppers facing a “limit 12” sign bought about 7 cans on average, versus about 3.3 cans with no limit. The number 12 seeded a target, and people adjusted down from it — landing far above where they’d have started on their own.

The mechanism is one clean idea: you don’t judge a price against its true worth, you judge it against a nearby number. Whoever controls the nearby number controls how the price feels.

Real estate: the anchor that fools the experts

Here’s where it stops being cute. Surely a trained professional — someone who appraises houses for a living — is immune? Northcraft and Neale (1987) checked. They walked both students and experienced real-estate agents through the same actual house, handed them a full information packet, and varied one thing: the listing price on the sheet.

The appraisals moved. Both groups’ estimates of the home’s value shifted substantially toward the listing price they’d been shown — a higher listing produced higher appraisals of the identical property. The kicker: when asked what factors they’d used, the agents overwhelmingly said the listing price was not among them. They believed they’d reasoned from the fundamentals. The anchor worked precisely because they never noticed it working.

This is the expert blind spot. Expertise gives you more facts to adjust with, but it doesn’t switch off the reflex to start from the number in front of you — and it adds a dangerous bonus: the confidence that you’re immune. “I’m a professional, this doesn’t affect me” is not a defense. It’s often the tell.

Courtrooms: sentences pulled by a roll of the dice

If real estate is unsettling, this one is genuinely dark, because the currency isn’t dollars — it’s years of a person’s life.

Englich, Mussweiler, and Strack (2006) gave experienced German judges and prosecutors a realistic criminal case file and asked for a sentencing recommendation. Before answering, participants rolled a pair of dice that were secretly loaded to land on either a low or a high total. They then noted whether the prosecutor’s demand would be higher or lower than that dice number, and finally gave their own sentence.

The dice — a transparently random, meaningless number the participants had literally just rolled themselves — pulled the sentences. Judges who rolled high recommended noticeably longer prison terms than judges who rolled low, for the identical case. A separate strand of the work shows the same pull from prosecutor demands: a steeper demand drags the final sentence up, even when the judge is supposed to weigh it independently.

Sit with that. Trained legal professionals, deciding how long a human being loses their freedom, were measurably moved by a random number with zero informational content. The anchor didn’t have to be relevant. It didn’t even have to be plausibly relevant. It just had to be present at the moment of judgment.

Estimates, forecasts & planning: the quiet everyday version

The dramatic cases grab headlines, but anchoring does most of its damage in beige, everyday numbers nobody screenshots.

  • Budgets and forecasts get anchored on last year’s figure or the first draft someone circulated. Next year’s number becomes “roughly this year’s, plus or minus a bit” — adjustment, not reasoning from scratch.
  • Salary negotiations hinge on the anchor. The “What’s your current salary?” question isn’t small talk; the answer becomes the reference point your raise is adjusted from. Ask for a range and the bottom of your range tends to become the ceiling of their thinking.
  • Medical and probability estimates drift toward whatever figure was mentioned first — an initial risk percentage, a colleague’s early guess, the number on the referral.

Same lever every time. Somebody put a number on the table, and everyone else did math relative to it instead of from the ground up.

What ties it all together

Notice the pattern across every domain: the anchor never had to be true, fair, or even relevant. A lowball, a struck-through price, a listing sheet, a rolled die — none of them delivered value or changed anyone’s actual payoffs. They just arrived first and set the reference point everyone else adjusted from.

That’s why it’s the ultimate cheap lever. Real incentives are expensive — you have to actually lower the price, or offer more money, or add a feature. An anchor costs nothing. You say a number, and behavior bends toward it. The house is still the same house; the case is still the same case; the soup is still the same soup.
